This Privacy Policy explains how Rafael Barbosa, Licensed Real Estate Salesperson, collects, uses and protects information you provide through rafaelbarbosa.com (the "Website"). The Website and the text messaging program described below are operated by Barbosa Corp, Rafael Barbosa's real estate business. In this policy, "I", "me" and "my" refer to Rafael Barbosa and Barbosa Corp.

1. Information I collect

Information you provide when you fill out a form, request a home value, net proceeds estimate or consultation, or contact me:

  • Name
  • Email address
  • Phone number
  • Property address
  • Any message or details you choose to share

Information collected automatically when you visit, such as IP address, browser type, pages visited and time on the site. This is used in aggregate to keep the Website secure and working.

2. How I use your information

  • To respond to your inquiry and provide real estate services
  • To prepare valuations, net proceeds estimates and market information you request
  • To schedule and confirm appointments
  • To send occasional market updates by email, which you can stop at any time
  • To keep records of our communication in my client management system

3. Text messaging (SMS) terms

  • Program. Rafael Barbosa client text messages, sent by Barbosa Corp from 914-430-0440.
  • How to opt in. Check the optional box "Text me about my inquiry and appointments" on the contact form at rafaelbarbosa.com/contact/ and enter your mobile number, or text 914-430-0440 first. The box is never pre-checked.
  • Consent. I send text messages only to people who check the text message consent box on a form, text me first, or otherwise give express consent. Consent to receive texts is not a condition of any purchase or service.
  • Messages you may receive. Replies to your inquiry, appointment scheduling, confirmations and reminders, and updates about your transaction or property.
  • Frequency. Message frequency varies based on your inquiry and activity.
  • Cost. Message and data rates may apply.
  • Opt out. Reply STOP to any message to stop receiving texts. You will receive one message confirming that you have been unsubscribed. Reply START to resubscribe.
  • Help. Reply HELP for help, or call or text 914-430-0440, or email rafael@compass.com.
  • Carriers. Carriers are not liable for delayed or undelivered messages.
  • No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

4. Email

You can unsubscribe from marketing emails at any time by replying "unsubscribe" or using the link in the email. Messages about an active transaction or appointment may still be sent.

5. How information is shared

I do not sell, rent or trade your personal information. Information may be shared only:

  • With service providers that help run the Website, email and phone systems, under obligations to protect it
  • With other parties to your transaction, such as attorneys, lenders or other agents, when you ask me to or when it is needed to complete your transaction
  • When required by law, real estate licensing regulations or legal process

6. Cookies and third-party tools

The Website may use cookies and similar tools to function and to understand traffic. The home value tool is provided by Homebot, and its use is governed by Homebot's own privacy policy. You can block cookies in your browser settings, though some features may not work.

7. Security and retention

I use reasonable administrative and technical safeguards to protect your information. No method of transmission over the internet is completely secure. Information is kept only as long as needed for the purposes above or as required by law.

8. Your choices

You may ask to see, correct or delete the personal information I hold about you, subject to legal record-keeping requirements, by emailing rafael@compass.com.

9. Children

The Website is not directed to children under 13, and I do not knowingly collect their information.

10. Changes

This policy may be updated from time to time. Changes are posted on this page with a new effective date.
